TERMS OF SERVICE | FALCOR

Welcome to falcor.one. This website is administered by FALCOR, based in Germany. These Terms of Service ("Agreement") govern your access to and use of our site and the purchase of our pieces. By accessing the site, you acknowledge that you have read, understood, and agreed to be bound by this Agreement.
1. SCOPE & CONTRACT PARTNER
The following terms apply to all orders placed via our online shop. Your contract partner is FALCOR, Germany. The language of the contract is English (or German, depending on your browser settings). We reserve the right to update these terms at any time to reflect changes in our craft or legal requirements.
2. CONCLUSION OF CONTRACT
The presentation of products on falcor.one does not constitute a legally binding offer but an invitation to browse our collection.
The Offer: By clicking the checkout button, you submit a binding offer to purchase the items in your cart.
The Acceptance: A contract is only concluded when we accept your offer by sending a separate shipment confirmation email. Receipt of an order confirmation email does not equate to acceptance.
Right to Refuse: We reserve the right to refuse or cancel orders due to pricing errors, suspected fraudulent activity, or stock unavailability.
3. PRICES, SHIPPING & PAYMENT
Currency & Taxes: All prices are quoted in Euro (€). For orders within the EU, prices include statutory German VAT. For international orders, any local customs duties or import taxes are the responsibility of the customer.
Payment Methods: We utilize secure third-party providers (including Shopify, Stripe, and PayPal). Your payment information is encrypted and handled according to the highest security standards.
Retention of Title: The delivered goods remain the property of FALCOR until full payment has been received.
4. RIGHT OF WITHDRAWAL (RETURNS)
In accordance with EU law, consumers have a statutory right of withdrawal.
Period: You may return your purchase within 14 days of receipt.
Condition: To maintain the "FALCOR Standard," items must be returned in their original, unused, and resellable condition. Protective films on timepieces must remain intact.
Customization: Any customized or engraved items are excluded from the right of withdrawal and are final sale.
5. WARRANTY & LIABILITY
Statutory Warranty: German statutory warranty rights (Mängelhaftung) apply to all products.
Limited Lifetime Warranty: In addition to your statutory rights, we provide a limited warranty on the movement of our timepieces, covering manufacturer defects.
Limitation of Liability: Our liability for damages is limited to the purchase price of the goods, except in cases of gross negligence, intentional misconduct, or injury to life, body, or health.
6. INTELLECTUAL PROPERTY & CONDUCT
The FALCOR name, our "HEART" model, logos, and all site content are the exclusive property of FALCOR.
Personal Use Only: You are granted a limited license for personal use. Any resale of FALCOR merchandise for commercial profit is strictly prohibited.
User Content: If you share photos or testimonials, you grant FALCOR a perpetual, worldwide license to use that content for marketing purposes.
7. ONLINE DISPUTE RESOLUTION (ODR)
The European Commission provides a platform for online dispute resolution (ODR), accessible here: https://ec.europa.eu/consumers/odr. FALCOR is neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
8. FINAL PROVISIONS
This Agreement is governed by and interpreted under the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If any provision is found to be invalid, the remaining terms shall continue in full force and effect.
